OMG- it's happened to us! Someone cleared out our business account today- used check #1 and wrote the check for the exact amount that we had in the account. We have to be at the bank tomorrow at 9 am to close out that account and to file a report. We'll get the money back but it could take up to a month
What bothers me is the bank allowed a check to be cashed with a check number 1 and for the exact amount in the account- down the the penny. I sure see alot of red flags!

I'm not sure how much more stress I can handle before I crack.

Oh Snowy!!!! Like you need this on top of everything else!  You know... I have to agree with you about the bank clearing this check.  Very odd.  Our bank has called me on a 15 dollar check when they thought the signature was questionable....so what is the deal with the bank accepting this,  or not even questioning it?  Very odd.  Anyway,  I hope that gets all cleared up!  Here is some more PD!!!

Just what you need right now. At least you get it back, but the paperwork you have to go through is a pain.
My thought is how did they find out the exact amount you had in the bank and then they didn't question closing out the account, particularly with a counter check. That is strange since on line or by phone we have to go through a password sequence to get our information. Also, your a valued customer and they would not want to lose you. You would think the bank manager would have been right on top of that one.

Oh Snowy! How horrible! Identity theft is my worst nightmare. It happens so easily to so many now. I am really paranoid about that happening to us....I'm always cautioning my older girls to be careful and protect themselves. It seems these thieves can crack anything! And, often, they are not even in this country! So scary! I almost assume it WILL eventually happen to us too. Isn't that awful...it's just that common. Like a virus going around that you figure you're probably going to catch sooner or later!
 
I hope it all works out with a minimum of headaches for you. If they didn't heed the red flags they should have in the first place...at least it was discovered quickly and not weeks later when your statement arrived or you tried to write a check on that account yourself. (My neice and her husband made the discovery when on their vacation in Hawaii when they tried to use their credit card!) Here's pd to help things along Snowy! Good luck honey!

Thank you for the dust!

First off let me just start off by saying- our local bank was recently bought out by a big bank- it's been nothing but a nightmare. Last night just added to the nightmare.
I don't understand how folks at the 1 -800 call center can be sooooo - ya know, unhelpful with the info.

Here's the story:
Yesterday I went to the bank and made our deposits- didn't notice the balances until we were on our way to dinner- which was after 6 pm so the local branches were closed. I noticed the business account was at zero. Not possible. So Erin calls the bank center- who told him the account has been seized either by the IRS or the state, but all of the money was taken out. I can't talk with them about this account because my name is not on the account.
Erin is in a panic- of course, as he's telling me this, I can't help but start laughing. Because I know for a fact- 100% sure this can't be the case.
He asks me, why are you laughing and so calm? How can you be??
I explain, there's NO chance the account has been 'seized' and we talk about that. I pay the taxes, we're not behind- that's NOT what happened. I tell him to call back.
Now he gets told well, it looks like someone cashed a check- so that throws Erin in a tailspin.... I tell him, just relax, I'll go online after we eat.
He's mad that I can even think of eating!! Well, it's 6:30 and I hadn't had a bite of food all day- so yeah, I'm going to eat.

We get home, I look at the account- it says there's a hold for the entire balance and in the pending box is an neg. amount. Hmmmm, that's odd.
I add the 2 amounts together and tell Erin he had recently {or actually I} I deposited one of his paychecks for that exact amount. It must have been returned--- AGAIN! this is the 2nd attempt to collect our money from this person.
Erin calls the bank back- who tells him NO... that someone went to the bank- location xxxx and cashed a check for xxxx amount of money at 2:03 pm with teller John.
Too many red flags there for me to believe that? But the guy explains be at the bank first thing to close that account and open a new one.

Anyhoooo, what happened was what I said- the deposited check bounced again from our account. There was no check cashing, there was no seized accounts from the IRS. I'm just shaking my head-

Erin has called the guy several times today, but of course, no answer!!! I'm here to tell you if he doesn't make good on this- I'm going to the police for a bad check. I'm done playing around.

Once, maybe give him the benefit of doubt. Twice, go straight to the bad check squad. He knew it was a bad check and was stalling for time.

 Snowy   I hope you can get this all corrected soon.  I also agree with mickeefan that this person needs to be reported to the authorities for writing bad checks.

Well, at this point, still no money- but he says he'll pay us this afternoon. But the funny thing is he said he would pay us yesterday morning, then by this morning at the latest...
He's lucky Erin is such a nice guy {or sucker} because I'm ready to put on my Cruella coat and go get my money!!

With his song and dance, I would make him pay CASH and he wouldn't get that bounced check back until he has paid cash.
I have no mercy for anyone who clearly knew the check would bounce.
My guess is the way he is stringing you along that he just does not have the money.

Well, Erin picked up some of the money today in cash- he says he'll have the rest on Friday. He's also paying for all of the return fees- because Erin had paid for the materials and labor from that check. It's not like we have $10,000 extra dollars just lying around.

Oh boy! Missed this whole thing while we were off playing!
And those bank charges add up so fast too!
So scary these days!
